The Legal Status of Peyote or Lophophora Williamsii in the U.S. and Other Countries

The Lophophora Williamsii or Peyote cactus has become an interesting plant since the time when the native American Indians discovered what this small plant can do. Today, the use of the Lophophora Williamsii or Peyote cactus has become a subject of controversies in the United States as well as in other countries. This type of cactus contains the substance called mescaline which has hallucinogenic effects.
In the United States, the Peyote cactus as well as the Peyote seeds is one of those plants that are regulated because of the effects that it can provide the user. It is actually dubbed as Schedule 1 which means that it
is illegal to manufacture, possess, buy as well as sell or distribute the cactus without a DEA license. It is also stated in the US Federal law that the all parts of this plant regardless of whether it is growing or not like Peyote seeds, extract from any part of the plant, compound, salts, mixtures or preparation of this type of is regulated from use, possession as well as distribution. However, the regulation of this type of cactus does not apply to the nondrug use of the plant like the religious ceremonies of the Native American Church.
As for the International Law about the Peyote Cactus, the laws will vary depending on the country. In Australia, the plant is not scheduled federally yet it is considered as a controlled substance within the Australian Capital Territory. However, in Brazil, the Peyote cactus is actually under the list of controlled substances. The production, possession as well as the distribution of this plant is considered illegal. In France, this type of cactus is also considered one of the controlled substances. On the other hand, in Mexico, the Peyote cactus is dubbed with a Schedule 1 status yet there are some indigenous tribes in the country that are allowed to harvest the plant. This cactus is also considered as an endangered species in Mexico; thus, harvesting of the plant is controlled. Countries like Netherlands and Singapore are not specifically regulating the Peyote cactus. However, these countries have listed mescaline which is actually an active ingredient of the cactus as one of the controlled substances.
The laws governing the use, possession and trade of the Peyote cactus will vary depending on the state or country. Basing from the differences, it can be concluded the use of this plant must be regulated as much as possible as this may have some harmful effects on the body.
